These Terms of Service (“Terms”) govern your use of the QPONG mobile application and digital loyalty card platform (“App” or “Service”), operated by QPONG (“we,” “us,” or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
1. Use of the App
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal or business purposes in accordance with these Terms.
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code
- Use the App for unlawful, abusive, or fraudulent purposes
- Interfere with or disrupt the App, its servers, or networks
- Access or attempt to access data not intended for you
- Create fake accounts or manipulate loyalty card transactions
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the App.
Business accounts may require additional verification and must be created by an authorized representative of the business.
3. Accounts
Some features require you to create an account. You are responsible for:
- Providing accurate and complete information
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Subscriptions & Payments
The App offers subscription-based access to features for businesses.
- Payments are processed through Apple’s In-App Purchase system (iOS) or Google Play Billing (Android)
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
- Your Apple ID or Google account will be charged upon confirmation of purchase
- You can manage or cancel subscriptions in your device’s account settings (Apple ID settings or Google Play settings)
- We do not control refunds — Apple’s and Google’s refund policies apply
- Prices may vary by region and are subject to change with notice
5. Device, Network & Availability
The App requires a compatible device, operating system, and internet connection.
You acknowledge that:
- App availability and functionality may be affected by your device, OS, or network provider
- We do not guarantee uninterrupted or error-free operation
- You are responsible for any data or usage charges incurred
- We are not responsible for issues caused by connectivity, device limitations, or third-party service failures
6. Jailbroken or Rooted Devices
You must not use the App on devices that are jailbroken, rooted, or modified to bypass operating system security restrictions.
We are not responsible for any damage, data loss, or security issues resulting from such use. We reserve the right to block access from such devices.
7. Intellectual Property
All content, trademarks, logos, software, and other intellectual property in the App are owned by or licensed to QPONG.
You may not use our intellectual property without prior written permission.
User-generated content (such as business information) remains your property, but you grant us a license to use, display, and distribute such content in connection with the Service.
8. Third-Party Services
The App may contain links to or integrations with third-party services (including payment processors, app stores, and cloud services). We are not responsible for the content, policies, or practices of any third parties.
Your use of third-party services is subject to their respective terms and conditions.
9. Disclaimer of Warranties
The App is provided “as is” and “as available”, without warranties of any kind, express or implied.
We do not warrant that the App will meet your requirements, be uninterrupted, secure, or error-free.
We do not guarantee the accuracy, completeness, or reliability of any information provided through the App.
10. Limitation of Liability
To the maximum extent permitted by law, QPONG shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the App.
11. Termination
We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms or if required by law.
Upon termination, your right to use the App will immediately cease, and we may delete your account and associated data in accordance with our Privacy Policy.
You may terminate your account at any time through the App settings or by contacting us.
12. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date.
We will notify you of material changes through the App or by email. Continued use of the App after changes means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using the App and may delete your account.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
